These Terms and Conditions explain how you may access and use the Hamzaban website and online services. By visiting the website, booking a session, making a payment, or using any Hamzaban service, you confirm that you have read and agree to these terms. If you do not agree with any part of these terms, please do not use the services.
1. Hamzaban and Scope of Services
Hamzaban is an online platform that helps Farsi-speaking communities access counselling and psychological support. Services may include individual counselling, couples therapy, workshops, and group programmes, delivered through the website, Calendly, video calls, or other secure communication tools.
Hamzaban aims to make access to suitable counsellors and professionals easier, but the website is not a medical facility, emergency service, or substitute for specialist in-person care. The professional content of each session remains the responsibility of the counsellor or therapist delivering that service.
2. Clinical Limits and Emergencies
Hamzaban services are not designed for crisis situations, immediate risk, or medical or psychiatric emergencies. If you are thinking about harming yourself or others, are in immediate danger, are experiencing a severe mental health or medical crisis, or believe someone else is at risk, contact your local emergency services immediately or go to the nearest emergency department.
Information or guidance provided through the website or online sessions should not delay, replace, or prevent you from seeking in-person care from a doctor, psychiatrist, therapist, or other qualified professional. Hamzaban is not intended for official diagnosis, court reports, medical certificates, mandatory in-person assessments, or treatment that requires urgent in-person intervention.
3. Eligibility and User Information
To use our services you must:
- Be at least 18 years old, or use the services with the consent and supervision of a parent or legal guardian;
- Be legally able to accept these terms and receive the services;
- Provide accurate, complete, and up-to-date information for booking, payment, and communication;
- Have suitable internet access, a private environment, and the equipment needed for online sessions.
You are responsible for keeping booking links, emails, login information, and any other access details confidential. If you suspect unauthorised access or a security issue, please contact us as soon as possible.
4. Booking, Payment, Cancellation and Refunds
Some sessions and workshops are booked through Calendly or similar tools. The fee, session length, service type, and required information will be shown or communicated before the booking is finalised. You must use a payment method that you are authorised to use and are responsible for the accuracy of your payment and contact details.
If you need to cancel a booked session, you can submit a request via our session cancellation page. Submitting the form counts as immediate cancellation confirmation.
Refunds depend on when you cancel relative to the session start time:
- More than 24 hours before the session: a full refund of the amount paid.
- Within 24 hours of the session: paid fees are not refunded.
- No-show without prior notice: the full session fee applies and no refund is issued.
To cancel a session, go to /en/cancel or use the “Cancellation” link in the website footer. If a technical issue on Hamzaban's side prevents a session from taking place, we will either rearrange the session or issue a refund, depending on the circumstances.
5. Confidentiality and Privacy
Protecting your information and session content is important to Hamzaban. We handle personal data in accordance with our Privacy Policy, which forms part of these terms.
Session content is confidential, but confidentiality may be limited in the following circumstances, in line with law and professional standards:
- An immediate and serious risk to your life, health, or the safety of another person;
- A legal obligation, court order, or valid request from a lawful authority;
- Safeguarding a child, vulnerable person, or someone who may be at risk of abuse or serious harm;
- Professional supervision, where possible without identifying you.
6. Acceptable Use
You agree to use the website and Hamzaban services only for personal, lawful purposes connected with mental health and personal development. You must not:
- Access or attempt to access systems, accounts, servers, or information without authorisation;
- Send threatening, abusive, defamatory, unlawful, rights-infringing, or malicious content;
- Share or commercialise session links, educational content, or counsellor information without permission;
- Do anything that disrupts the security, availability, reputation, or operation of Hamzaban services.
7. Third-Party Services and Links
Hamzaban may use third-party tools for booking, payment, video calls, email, technical analytics, or other parts of the service. Your use of those tools may be subject to the relevant provider's own terms and privacy policies. Hamzaban is not responsible for the content, policies, errors, or availability of third-party websites or services outside our direct control.
8. Intellectual Property
The Hamzaban name, branding, design, text, images, page structure, educational materials, and other website content belong to Hamzaban or its authorised suppliers. Access to the website does not transfer ownership or grant permission to copy, republish, sell, modify, or commercially use the content without prior written consent.
9. Availability, Changes and Suspension
We aim to keep the services stable and secure, but we do not guarantee that the website, booking tools, or communication services will always be error-free, uninterrupted, or available. Hamzaban may change, restrict, suspend, or discontinue parts of the services for maintenance, improvement, security, legal, or operational reasons.
10. Disclaimer and Limitation of Liability
To the extent permitted by law, the Hamzaban website and services are provided on an "as is" and "as available" basis. Hamzaban does not guarantee that the services will be suitable for every person, every situation, or every therapeutic goal, or that any specific outcome will be achieved.
To the extent permitted by law, Hamzaban will not be liable for indirect, incidental, consequential, or special losses, loss of data, lost opportunities, or losses arising from misuse, inaccurate user information, third-party service failures, or failure to seek appropriate in-person care. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Changes to These Terms
Hamzaban may update these terms from time to time. The updated version becomes effective when posted on this page, unless another effective date is stated. Continued use of the website or services after changes are posted means you accept the updated terms.
12. Governing Law and Disputes
These terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these terms or your use of the services will, if not resolved through direct communication, be subject to the jurisdiction of the courts of England and Wales.
